Civil service is one of many duties the Hamlin County Sheriff's Office is required to provide under state law. Many people may not know officers with the department serve a number of papers to citizen at their residence, collect debt for distress warrants issued by the Treasure's Office, or collects money for Execution of Judgment, an order from the courts. The civil process also includes sheriff's sale, a written order to the sheriff to sell property that has been foreclosed.
South Dakota State Law 7-12-18 sets civil process fees for these services that the sheriff's office collects. At times, such fees may be collected before service begins.
Affidavits, Complaints, Notices, Orders, Three Day Notice to Quit, Summons, Small Claims, Etc.
If an additional person needs to be served the same set of papers (example: spouse) at the same time.
- This fee may be collected up front.
- Completion of Execution of Judgement or Order of Sale, Order of Attachment, Decree or on Sale of Real Property or Personal Property. Commission Fees May Apply.
Completion of Execution of Judgement, Order of Sale, Order of Attachment, Decree on Sale of Real Property or Personal Property, Commission Fees May Apply. Mileage may also be charged.
This fee may be collected upfront and is charged regardless of the outcome.
Additional mileage at $0.59 per mile is also charged on all civil process besides protection orders and arrest warrants.
